Section One:

Terms and conditions for website use. 

1. Acceptance of conditions and amendments

  • You must read these terms and conditions carefully before using this website under the domain name www.cpkids-physio.co.uk. Using this Website in any manner indicates that you accept these Conditions regardless of whether or not you choose to register your interest. If you do not accept these Conditions, you must not use this Website. 

  • These Conditions apply to the whole of the contents, to your use of the material on this Website and to any correspondence by e-mail/mail between us, (and any authorised person on our behalf) and you.

  • We may amend this posting at any time to revise these Conditions and you must check this Website from time to time to review the current Conditions, as they are binding on you. If you do not agree to the Conditions at any time you must cease further use of this Website. 

  • Express terms or legal notices elsewhere on this website may supersede some of the provisions set out on these pages. 

  • The provision of the website may be withdrawn or amended at any time without liability to you or any third party. 

  • In the case of Website system failure, maintenance or repair or for reasons beyond our control, access to this Website may be suspended temporarily and without notice.

  • The intellectual property rights and copyright in all material on this website are owned by Children’s Physiotherapy or its licensors (including without limitation photographs and graphical images).

  • For the purposes of these Conditions, any use of extracts from this Website other than in accordance with the above for any purpose is prohibited. If you breach these Conditions, your permission to use this Website will automatically terminate and you must immediately destroy any downloaded or printed extracts from this Website. 

  • Unless prior written permission is received from Children's Physiotherapy, no part of this Website may be reproduced or stored in any other website, or included in any public or private electronic retrieval system or service 

  • We reserve any rights not expressly granted in these Conditions.

While we endeavour to ensure that this Website is normally available 24-hours per day, it shall not be liable if for any reason this Website is unavailable at any time or for any period.

  • This also includes any websites linked to this website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this or linked websites, or your downloading of any material from this Website or any websites linked to this Website.

Section Two:

Terms and Conditions for the provision of Physiotherapy Services.

Set out below are the terms and conditions under which Children’s Physiotherapy

provide Physiotherapy services. Before you agree that Children’s Physiotherapy will provide services to you or your child please read these terms and conditions. 

If you have questions concerning the terms and conditions please ask to speak to Children’s Physiotherapy  using the contact details provided.

  1. Initial evaluation: Before we provide any services, we shall carry out an initial evaluation on you/your child which may be online or face-to-face to gather Information and to briefly assess your/your child’s needs and requirements to decide if they match what Children’s Physiotherapy can offer. If we consider Children’s Physiotherapy is suitable we can discuss options for therapy. It may be that we decide that we cannot provide any services in which case we will give our reasons and try to help you find services that are suitable.

  2. Physiotherapy Sessions: These sessions can be provided at home/school /nursery/relatives home in a flexible manner to suit both our service and your life style. We can provide treatment on a session-by-session basis or suggest a block of sessions. We will agree a venue, date and cost of the first session which will include any travel costs. You will receive a confirmation email before the first session and receive a follow-up invoice. 

  3. Payment: Please send payment preferably by bank or online transfer but we do also accept payment in cash, by cheque, or by debit/credit card. Please note that you are personally liable to pay all of our fees and any surcharges incurred, such as any cancellation fees. 

  4. Cancellation Policy: If you are unable to keep your appointment, please make every effort to cancel it well in advance so that it may be offered to someone else. Non-attendance and cancellations at short notice without a valid reason deprives other patients of essential therapy services. Between 9am-5pm weekdays, all appointment cancellations must be notified by telephone on 07854831486. Cancellations outside of these hours and at weekends should be emailed to pmchristmas@googlemail.com. Where sessions are cancelled with less than 24 hours’ notice no refund will be due, however we will try and replace it with a new session as soon as possible. Cancellations by Children’s Physiotherapy may happen due to unexpected situations such as illness or in severe winter weather conditions.  You will be informed of this at the first possible opportunity.

  5. Confidentiality: Children’s Physiotherapy will treat all personal information supplied by you as confidential. We shall not disclose such information to any third party without your prior permission, except where required by law or where action might be necessary to protect you or someone else.   6. Data Protection: We shall treat all personal data in accordance with the requirements of the terms of GDPR 2016 Regulations Please see Children’s Physiotherapy Privacy policy 

  7. Change to the terms and conditions. We may change any of these terms or conditions including our fees, so please review them regularly. Any change will always involve prior notice. 

  8. Disputes and governing law. If you are unhappy with the services Children’s Physiotherapy  has provided we hope that initially you will discuss any problems or issues with us. See “How to Complain”  in Children’s Physiotherapy Privacy policy. This agreement is governed and construed by English law and the parties submit to the jurisdiction of the Courts of England and Wales.

Section Three

Terms and Conditions for the Provision of Training

Children’s Physiotherapy provides training services and these are the terms and conditions on which we supply training services.

  1. What training do we provide and to whom? Evidence-based Practical Application for the treatment of children with cerebral palsy is the name of the training program we provide. It is delivered to physiotherapist, occupational therapists,  speech therapists, therapy technicians and assistants, carers, parents and educational staff.

  2. How do we provide training programs to you? You can buy training services from us as an individual i.e., for your personal use or you can host a course in connection with your business, or profession such as an in-house NHS trust or Educational centre.

  3. Who should read these terms and conditions? Whether, hosting a course for your business or attending a course program as an individual you should  read fully these terms and conditions .

  4. Booking Process: A course booking is not confirmed until receipt of payment or a purchase order. You will at that point, receive confirmation of your place on the course at which point a contract will come into existence between you and us.

  5. Payment: Please make payment within 4 weeks of the course booking. Children’s Physiotherapy reserve the right to cancel the booking if payment is not made within this time. 

  6. Unable to process your booking: If we are unable to accept your booking, we will inform you of this and will not charge you for the training course. This might be because the training course is fully booked.

  7. Rights to make a change: If you wish to make a change to the training course you have booked please contact us on 07854831486. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the training course, the timing of the training course or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. In the event that we need to make significant changes to the training course or these terms, we will notify you and you may then contact us to transfer the booking to another individual at no cost or to transfer your booking to another course.

  8. Transfer of booking to another individual: If you wish to transfer your booking on a specific training course to another individual, this is not subject to any transfer fee.

  9. Cancellation: Children’s Physiotherapy reserves the right to cancel courses if there are insufficient enrolments to deliver that course and in these circumstances will refund fees in full. Where a course is rescheduled for a new date and the participant can no longer attend, we will refund the course costs in full (not travel or accommodation). Therefore we ask course participants to book accommodation that is refundable and make contact before booking any non-refundable travel.

  10. Delays outside of our control; We are not responsible for delays outside our control: If the training course is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay we will use reasonable endeavours to book you onto an equivalent training course.

  11. Course information: During the booking process we will provide the relevant course information.

  12. Our communication with you: Information concerning your registration is held on our database under the terms of the Data Protection Act 1998. All communication regarding your booking will be by email. We will not pass on your personal details to any third party. Please see Children’s Physiotherapy Privacy policy.

  13. Your responsibilities: You accept that some courses have a practical component to them which if applied inappropriately may involve elements of risk or discomfort. By agreeing to these terms and conditions you take personal responsibility for your own actions. You must at all times work within your own ability and scope of practice. You must be physically able to partake in the course and if you do have any injuries, discomfort or prior knowledge that is relevant to any activities being performed it is your responsibility to make those known. Children’s Physiotherapy cannot be held responsible for damage and/or loss to your personal possessions during a training event.

  14. Suitability for the training course: Please note it is your responsibility to ensure that you or any individuals you book on the training course are free from any condition which would affect your/their capability to undertake the chosen training course, and that you/they have the aptitude to cope with the course of study

  15. Students with disabilities. Children’s physiotherapy welcome students with disabilities but in advance of the course would prefer, for setup purposes, notification of any assistance that a student is likely to need during the running of the course.

  16. Complaints: Should you have a problem or complaint with any of the training courses you must bring it to the attention of PM Christmas (pmchristmas @googlemail.com.) as soon as possible who will try to rectify the problem. If you feel that the problem was not resolved and resulted in a specific issue  associated with the course you must inform us within one-month and we will respond within one-month and aim to resolve the matter to the satisfaction of both parties.

  17. Refusal to continue to participate: We reserve the right to refuse to allow you to participate, or continue to participate, in the training course if you give cause for concern. For example, if your continued participation may cause offence or injury to yourself or other participants. This will not entitle you to any refund.

  18. Your rights to end your contract with us: You can always end your contract with us: Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing, when you decide to end the contract. For example, you may have changed your mind  and  don’t want to attend the course, or the training course is misdescribed. We shall use reasonable endeavours to offer you an alternative training course and your rights will depend on the reasoning. If you decide to cancel  more than four-weeks before the training course is due to commence you will be entitled to a full refund of the booking fee. Between 2-4 weeks before the training course is due to commence: 50% of booking fee will be refunded. Less than 2 weeks before the training course is due to commence, the booking fee will not be refunded. In all cases, notice of cancellation must be confirmed in writing addressed to the contact details on the booking confirmation.

  19. How to end the contract with us (including if you have changed your mind). Tell us you want to end the contract: To end the contract with us, please let us know by phone 07854831486 or email us pmchristmas@googlemil.com. Please provide your name, address, details of the booking and, where available, your phone number and email address.

  20. How we use personal data when you book training as an individual: When you book direct with us as an individual  then Physiotherapy is the ‘data controller’ for your personal data. Our full privacy policy is available on our website at www.cpkids-physio.co.uk. To register with us we ask you to complete a Registration form. We use your name and contact details to take your booking and send you joining instructions, and to provide you with the training information and to issue your certificate. If you provide us with information about making the course accessible to you we will only use it for that purpose. On the Registration form we ask for your consent to use your personal information to contact you about upcoming training courses.  We will only do that if you give your consent. If you would like a copy of your personal data, or would like us to delete it or stop using it, then please let us know by contacting us (phone 07854831486 or email us pmchristmas@googlemil.com.) You can find out more information about your data rights on the Information Commissioner’s website https://ico.org.uk/. If you are not happy with how we have used your personal data you have the right to make a complaint to the Information Commissioner's Office (ICO) by phoning 0303 123 1113 or writing to casework@ico.org.uk.   21. Personal data when a business is hosting a training course: In this case you as the business/the organisation hosting the course is the “data controller” and takes full responsibility for data governance including personal data.  They may offer places to other delegates outside of their organisation only with agreement of PM Christmas and if they do they are responsible for data governance including personal information for the external delegates. If you are an external delegate and wants to know about your personal data you need to contact them directly.

  22. Intellectual Property Rights and Confidential Information: Delegates will be provided by course materials either hard copies or virtually which can be taken away by delegates at the end of a course. All intellectual property rights in any such materials shall be owned by us.

  23. Retention of our intellectual property: Participation in the training course does not confer any intellectual property rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property of  Children’s Physiotherapy or in the materials referred to in item 23. I acknowledge and agree that this E-BPA course and the content therein is the sole property of Children’s Physiotherapy and is protected by copyright laws.

  24. Confidential information: In the event that we disclose any confidential information to you, you agree that you shall not at any time disclose to any person any such confidential information except at may be required by law, court order, or any governmental or regulatory authority.

  25. Release of Liability for healthcare professionals: 

By enrolling  on this E-BPA Course, I hereby represent, acknowledge and agree to the following:

  • I represent that I am a qualified participant in this Course which is designed for healthcare professionals.

  • I understand that, as a healthcare professional, I am solely responsible for my actions in the treatment of patients and any use of the material presented in the Evidence-base Practical Application courses. 

  • These Courses are for educational and informational purposes only and does not constitute medical advice. Content in this Course is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • To the extent that I have accessed this E-BPA course through links provided on any website that is owned and operated by Children’s Physiotherapy , I have reviewed, and agree to, the Terms of Use and the Privacy Policy of such website.

  • I acknowledge and agree that this E-BPA course and the content therein is the sole property of Children’s Physiotherapy and is protected by copyright laws. I agree not to copy, reproduce, transcribe or otherwise use the content of this E-BPA course unless I have been given express written consent by Children’s Physiotherapy 

 

26. Disclaimer: In consideration for receiving the instruction provided by this E-BPA course,

  • I hereby waive and release Children’s Physiotherapy, its owners, agents, employees, and contractors, and agree to reimburse and hold such parties harmless, from any and all liability, claims, damages, actions and causes of action whatsoever, for loss, damages, or injury to person or property, irrespective of how arising and however caused, including but not limited to all kinds, degrees, and extents of negligence (other than wilful or gross negligence) of Children’s Physiotherapy, its owners, agents, employees, and contractors, whether directly or indirectly related to such training and instruction presented through this E-BPA Course, or the facilities and equipment used by me to access the Course.

 

  • I understand and agree that this release and waiver of liability constitutes a complete waiver of my right to sue and collect damages from Children’s Physiotherapy , and its owners, agents, employees, and contractors, regardless of whether any of such parties acted negligently.

  • If any portion of this Release of Liability is found by a court of competent jurisdiction to be invalid or unenforceable, then I acknowledge and agree that the remaining terms and conditions of this Release of Liability shall remain in full force and effect to the fullest extent permitted by applicable law.

  • I recognise that the instruction I will receive through this does not constitute essential services and that I could obtain similar services elsewhere. I represent that no special relationship exists between me and Children’s Physiotherapy and that I am under no physical, economical, or other compulsion to sign this Release of Liability. I acknowledge that the instruction that I will receive from Children’s Physiotherapy through this E-BPA course is sufficient consideration for signing this Release of Liability.

  • I understand and agree that this release of liability releases Children’s Physiotherapy and its owners, agents, employees, and contractors, from any liability for any failure by any such party to use reasonable care in any way. I recognise and understand that this is a release of all current and prospective claims.I have read this release of liability before agreeing to these terms and conditions.

  • I understand that I must always practice within the scope defined by the professional body through which I am registered as a health care professional.

27. Terms of the contract: This contract is between you and us. No other person shall have any rights to enforce any of its terms. We may transfer our rights and obligations under these terms to another organisation. If this is the case we will contact you to let you know. You need our consent to transfer your rights to someone else: You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. Nobody else has any rights under this contract (except someone you pass your guarantee on to): other than where an employer books a training course for employee(s), â€‹

28. Items in the contract: Each term of the contract are separated by paragraphs. Each of the paragraphs operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

29. Delay in enforcing this contact: Even if we delay in enforcing this contract, we can still enforce it later: If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

30. Freedom of Information: Where you are a Public Authority as defined in the Freedom of Information Act 2000 (the “FOIA”) you agree to notify us immediately if you receive any FOIA request for information regarding Children’s Physiotherapy, and you agree to consult with us regarding the application of any exemptions under the FOIA in relation to such request. We agree to cooperate with you in relation to the FOIA.

31. Contract if you are a business customer hosting a course: This contract represents the terms of the agreement between us. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement. If you are a business customer , any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

32. Laws which apply to this contract if you are a consumer: The terms by which you may bring legal proceedings if you are a consumer are governed by English law. You can bring legal proceedings in respect of the training course in the English courts. If you live in Scotland you can bring legal proceedings in respect of the training course in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the training course in either the Northern Irish or the English courts.

33. Regular review  of terms.These terms are correct at the time of printing, but are subject to alteration. We thank you for your cooperation and suggest that you review them regularly.
